Is The United States Income Tax Constitutional?

In the hopes of learning something new today, I’m going to discuss the Sixteenth (16th) Amendment to the United States Constitution.

WHAT DOES THE 16th AMENDMENT DO?

Many people may not know this, but as originally written, the United States government could NOT impose an income tax on the people, because it was prohibited under the original language of the constitution.

In 1913, the then Secretary of State Philander C. Knox reported that 38 states out of the 48 then in existence had ratified the amendment.

SOME PEOPLE CLAIM IT WAS NEVER PROPERLY RATIFIED

Over the past 3o to 40 years, countless people have made claims that the amendment was never properly ratified and thus the United States income tax is unconstitutional.

These same people have refused to file and pay their income taxes for a variety of reasons.  In pretty much all cases, they have lost in court and many of them have gone to prison for income tax evasion.

Nonetheless, to this day, the United States Internal Revenue Service will tell you there is a large number of people who refused to file and pay their income taxes, despite the fact the courts have NEVER ruled in their favor.

THE CONCLUSION

As a tax attorney and CPA, I frequently get asked by people about these claims.  I’m here to tell you to NOT rely upon anyone who makes these claims to you that the United States income tax is unconstitutional.  If you don’t like the system, write your congressman and work on trying to get it changed.  HOWEVER, I do NOT recommend that you ignore the system.  That will only get you in trouble.

It is fruitless to argue the legitimacy of the 16th amendment. The reality is that Congress is directly taxing all sources of income as forbidden by the Constitution as originally crafted. I agree that we shouldn’t refuse to pay our taxes on the claim that income taxation is unconstitutional. Our founding fathers made it unconstitutiona predicting that giving this power to Congress would herald the end of our Republic. And so the end of our Republic is rapidly approaching.

A National Day of Mourning has been proclaimed for July 12, 2009, as it is the Centennial of the Birth of the 16th Amendment. On that day of infamy the 61st Congress passed the 16th to the States beginning the ratification process which took until early 1913 to be completed. In 1913 Congress passed the Federal Reserve Bill giving to powerful private bankiing interests its power to “coin money and determine the value thereof”. Thus Congress took two great “self-corrupting” steps which have gradually transferred power from we the people to they the Congress. Congress no longer represents the people but dictates to the people.

That case was not a federal appeals court case.
